AI Policy SoundBerry

This document describes the use of artificial intelligence tools within the Software Platform (hereinafter also "Platform") produced and marketed by SoundBerry S.r.l. (hereinafter "SoundBerry"), which assists Users in music production activities.

SoundBerry is committed to ensuring compliance with the principles of legality, fairness, and transparency in the use of AI systems.

SoundBerry's technology is developed to act as a production assistant. Creative control, artistic direction, and final decisions remain exclusively in the hands of the User. The goal is to automate technical tasks (track separation, technical analysis, stem synthesis, etc.) to leave more room for inspiration, without replacing human intervention.

Each AI system implemented within the Platform is designed and managed in accordance with Regulation (EU) 2024/1689 ("AI Act") and Italian Law No. 132/2025 implementing it, as well as in full compliance with Regulation (EU) 2016/679 ("GDPR") and national legislation on the protection of personal data.

Scope and Purpose

The Platform is aimed at optimizing the creative workflow in music production, providing Users with the following features:

Assisted Creative Synthesis: providing Users with the ability to generate granular sound components (Stems) from textual descriptions (Text-to-Music), enabling the creation of original elements.
Audio Analysis and Decomposition: enabling technical analysis of existing audio files for the extraction of metadata (BPM, key, scale) and the decomposition of complex tracks into their constituent elements (Vocals, Drums, Bass, Other) through source separation algorithms.
Professional Integration: facilitating the use of AI technologies directly within professional production environments (DAWs) through dedicated plugins, ensuring fluidity between algorithmic generation and manual editing.
Workflow Enhancement: acting as a technical extension capable of generating content consistent with the audio material already present in the User's work sessions, avoiding random generation in favor of a contextual approach.

The Service is aimed at providing sound material. SoundBerry S.r.l. does not aim to replace the author, nor to autonomously create finished works without human intervention. The User acknowledges that the final value of the produced work resides in the combination, editing, and artistic direction imparted by the User to the outputs provided by the Platform.

System Functioning and Intellectual Property

The models developed by SoundBerry were trained on proprietary datasets.

SoundBerry uses data uploaded by the User to the Platform solely for the purpose of returning the requested output.

SoundBerry guarantees that files, vocal content, and any other type of data or information uploaded by the User to the Platform will not be used to train, refine, or improve AI models, nor will they be shared with third parties for any purpose. Should SoundBerry, in the future, intend to use User data and information for AI model training to improve the service provided, no operation will be carried out without the User being informed in advance and expressly consenting.

Processing of Personal Data

During the use of the Platform's features, SoundBerry may process, including through the AI systems implemented therein, personal data of Users, such as by way of example: User ID, content containing the User's voice, technical and usage data necessary to ensure the proper functioning of the service.

All processing is carried out in compliance with the principles of lawfulness, data minimization, and purpose limitation established by the GDPR.

Data is retained for the time strictly necessary for the provision of the service or to fulfill legal obligations and is protected by technical and organizational security measures that ensure adequate levels of protection.

Regulatory Compliance

In accordance with Art. 6 of the AI Act, the Platform uses AI systems qualifying as "limited risk systems". SoundBerry S.r.l. adopts adequate transparency measures aimed at informing Users about the use of AI systems and maintains technical documentation containing a description of the implemented models.

User Rights

Users have the right to request, at any time, further information on the use of AI systems and the processing of personal data carried out by SoundBerry. Requests may be sent to the email address info@soundberry.ai. SoundBerry is committed to providing responses as soon as possible upon receipt of the relevant requests.

Users may also report any errors or anomalous AI behaviors, which will be analyzed by the SoundBerry technical team in order to adopt, if necessary, corrective or improvement measures.

Updates

SoundBerry S.r.l. reserves the right to modify this Policy at any time, in order to adapt it to regulatory changes, technological improvements, or new features introduced in the Platform, publishing the updated version on the site https://soundberry.ai and sending a communication via email to already registered Users.
